Federal Court of Appeal dismisses JNF Canada appeal from Federal Court decision

On June 2, 2025, the Federal Court of Appeal released a decision in Jewish National Fund of Canada Inc. v. Canada (National Revenue) (2025 FCA 110) (PDF version).

JNF Canada had gone to the Federal Court with an application for judicial review, and JNF Canada had lost previously.  Essentially, the Federal Court said that the Federal Court does not have jurisdiction to deal with judicial review of the publication of a Notice of Intention to Revoke the charitable status of JNF Canada.  JNF Canada appealed that decision of the Federal Court to the Federal Court of Appeal and the Federal Court of Appeal agreed with the Federal Court decision that the Federal Court does not have jurisdiction to hear the matter.  This does not mean that the saga is over.  This was more of a technical decision relating to what is the right forum to challenge a Charities Directorate decision to revoke the charitable status of a registered charity.

You see, there are a number of different applications and appeals launched by JNF Canada.   The more substantive matters have yet to be decided by the Federal Court of Appeal, and we will soon be one year since the revocation of JNF Canada.
