Expanding Objects of an Existing Charity

Some charities that are expanding their operations and undertaking new types of projects run into an issue when they realize the work they would like to do is outside the scope of their legal objects. Likewise, some charities are already carrying out charitable activity that technically falls outside of their existing legal objects. This presentation will discuss the importance of a charity’s legal objects: what objects are, where to find your organization’s objects, and how to determine if a certain activity falls within those objects. In addition, the presentation will discuss how an existing charity can apply to CRA to expand the scope of its current objects.

This webinar will be presented by Helene Mersky, an associate lawyer at Blumbergs where she works exclusively in the areas of Non-Profit and Charity Law. Since 2017, Helene has worked with clients to ensure their operations are compliant with relevant laws and best practices. In this capacity, she advises clients on various matters relating to non-profits and charities, including compliance issues, gifting, receipting, various agreements, risk management, restructuring, corporate governance, foreign activity, and amalgamation. Helene also works with new organizations, helping them incorporate and gain charitable status with the Canada Revenue Agency.

Helene is licensed in both Ontario and New York State. Prior to joining Blumbergs, Helene was a litigator in New York City where she practiced medical malpractice defence. She specialized in the defence of complex, high-exposure medical malpractice cases. Helene received a Bachelor of Business Administration (BBA) degree from the University of Miami in 2010 and a Juris Doctor (J.D.) degree from Brooklyn Law School in 2013.
