ONCA was originally passed in 2010 and was expected to come into force in 2013, but unfortunately, it had been delayed many times. ONCA was brought into force on October 19, 2021. It applies to all non-share capital corporations currently under the Ontario Corporations Act (“OCA”). What should your OCA corporation do? There are a number of options, and we will discuss them in this webinar including making changes to bring your non-profit into compliance with ONCA and another viable option for an Ontario non-profit corporation is to transfer to the federal jurisdiction by continuing under the Canada Not-for-profit Corporations Act (“CNCA”).
